How healthy is the tree? How long do such trees normally live? If they develop around it, will that weaken it? What happens when it gets old and falls down, or over, especially in strong winds? Who'll be liable? Who'll get hurt or killed? What will be damaged?
Maybe the neighborhood could cough up some insurance coverage and sign statements indemnifying the developer and future site owner(s).
Don't get me wrong, I love trees. I just love safety too.
